Special Education

Section 504

Section 504 is federal civil rights law under the Rehabilitation Act of 1973. The U.S. Department of Education’s Office for Civil Rights (OCR) administers Section 504—not the State. Section 504 is the other service option available to students with disabilities, but who are not eligible and/or already receiving special education services under the eligibility requirements of the IDEA. It is designed to provide equal access and fairness in general education to students with disabilities, thereby leveling the playing field for them. Gifted Education

In the state of New Mexico, gifted education falls under the umbrella of special education. Students suspected of giftedness are identified through a process outlined in South Valley Prep's Gifted Education Program Plan.

As described in the New Mexico Public Education Department Gifted Education Technical Assistance Manual, a “gifted child” means a school-age person whose intellectual ability, aptitude/achievement, creativity/divergent thinking, problem-solving/critical thinking, artistic abilities or leadership abilities meet the eligibility criteria in the New Mexico Administrative Code and for whom a properly constituted IEP team determines that special education services are required to meet the child’s educational needs.

Programs are developed for each student through the Gifted Individualized Education Program (G.I.E.P.). At South Valley Prep, services for eligible students are provided through the general education program with a mix of direct and indirect/consult services from the gifted student's assigned case manager.

McKinney-Vento is a federal act that was established in 1987 to ensure that unsheltered students would have the same educational experiences as their peers. This program is vital to our community here at South Valley Prep as we strive to provide equal opportunities inside and outside of the classroom for all our students.

Eligibility is determined by a student’s housing situation. Students may be eligible for additional support through McKinney-Vento if they are living in a shelter, motel, vehicle, on a campground, on the street, in abandoned buildings, or doubled-up temporarily with relatives or friends due to loss of housing. Additional circumstances can qualify your student for McKinney Vento, such as a family being unable to pay certain bills (gas, electric, etc.) due to financial hardship.

Through McKinney-Vento, we can provide support to unsheltered students and families in various ways including, but not limited to:

• Clothing, food, & hygiene assistance
• Free school supplies
• Enrollment assistance
• Free tutoring and mentorship services
• Free health screenings and referrals
• Transportation assistance
• Motel/hotel vouchers

The Anti-Racism Anti-Oppression Portal is a resource created by the Black Education Act (House Bill 43) that is available for students, families, staff, community members, and any stakeholders to report school-based incidents of racism, injustice, or discrimination against anyone.

The ARAO portal is a neutral bridge that supports communication between districts, schools, students, and their families. The ARAO Portal covers racialized incidents that happen within New Mexico schools.

Filing a Report

South Valley Preparatory School students are required to participate in school and district assessments. Assessments used are as follows:

Northwest Evaluation Association (NWEA).

State-Mandated Assessments.
